These Terms of Service (“Terms”) govern your access to and use of the website botfanatics.com and any related dashboards, automations, and services (collectively, the “Services”) provided by Bot Fanatics, operated by Battleplan LLC (“Company”, “we”, “our”, or “us”). By accessing or using the Services, you agree to be bound by these Terms.
You must be at least 18 years old and capable of forming a binding contract to use our Services. When you create an account, you agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity that occurs under your account.
You may use the Services only for lawful business purposes and in accordance with these Terms and all applicable laws, platform rules, and regulations (including Meta/Facebook, Instagram, WhatsApp, Google, and other integrated platforms).

Some features of the Services may require payment of fees or a subscription. By subscribing, you authorize us or our payment processors to charge your selected payment method for the applicable fees on a recurring basis (if applicable), plus any taxes.
Except where required by law or expressly stated otherwise, all payments are non-refundable. We may change our pricing and subscription plans from time to time with notice.
You may provide content, data, text, images, and other materials (“User Content”) through the Services, including content sent through bots, forms, and automations. You retain all rights to your User Content, but grant us a limited, non-exclusive license to use, store, and process it solely for the purpose of operating and improving the Services.
You are solely responsible for the legality, accuracy, and quality of your User Content and for obtaining any permissions required to use it with our Services.

The Services may integrate with third-party services such as Meta (Facebook/Instagram), Google, payment processors, email tools, and CRM systems. Your use of these third-party services is subject to their own terms and policies. We are not responsible for the actions or policies of third-party providers.
Your use of the Services is also subject to our Privacy Policy, which describes how we collect, use, and protect personal information. By using the Services, you consent to our data practices as described in the Privacy Policy.
All rights, title, and interest in and to the Services, including software, code, designs, logos, and trademarks, are owned by Bot Fanatics / Battleplan LLC or our licensors. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that they will meet your specific requirements or expectations.
To the maximum extent permitted by law, Bot Fanatics / Battleplan LLC and its owners, employees, and partners will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Services.
Our total aggregate liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the three (3) months prior to the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).
You agree to indemnify, defend, and hold harmless Bot Fanatics / Battleplan LLC and its owners, employees, and affiliates from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your User Content; or (c) your violation of these Terms or any applicable law.
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, misused the Services, or caused risk or harm to us, other users, or third parties. Upon termination, your right to use the Services will immediately cease.
We may modify or discontinue parts of the Services at any time. We may also update these Terms from time to time. When we do, we will update the “Last Updated” date above. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts.
